Sequel to the killing of Mr. John Pessu at the Ogbuwangue area of Warri by an Army officer on the 2nd day of April 2020, the National Publicity Secretary of the Nigerian Bar Association, Mr. Kunle Edun has filed a fundamental right enforcement proceedings against the Nigerian Army in Suit No. FHC/WR/2/CS/57/2020. Other Respondents in the case filed at the Federal High Court, Warri by The Registered Trustees of Centre for Transparency and Defence of Human Rights are the Chief of Army Staff, the Attorney General of the Federation, Attorney General of Delta State and Sgt. Ilekura Ajayi Samson.

In the matter the Applicant is seeking various declaratory reliefs including the payment of the sum of N3 billion naira as special, punitive and exemplary damages against the Nigerian Army, the Chief of Army Staff and Sgt. Ilekura Ajayi Sampson, and an order compelling the Attorney General of the Federation and the Attorney General of Delta State to arraign Sgt. Ilekura Ajayi Sampson before a court of law for the unlawful killing of late Joseph Pessu.
